Distracted driving can be a serious issue on Massachusetts roads. It is difficult to estimate its true cost since its role in accidents is not always easily determined, but experts agree that thousands of lives are lost each year to people getting distracted while behind the wheel. Whether it is caused by cell phones, drowsiness or other factors, driving while distracted has long been a concern of safety advocates. The Insurance Institute for Highway Safety has found that there may be measures beyond stricter laws and enforcement that can help reduce these behaviors.

Reducing harmful behavior

A common finding in traffic safety surveys is that even when people agree that certain behaviors are dangerous, they still engage in them. While there are several that can cause distractions while driving, such as eating, mobile phone usage remains a main concern. Therefore, safety advocates are looking at how people use their phones in their vehicles, what barriers exist to not using them and how social pressure can help reduce their usage.

Discouraging phone usage

Many drivers still do not understand that even a quick glance at a cell phone can cause motor vehicle accidents, but creating a social climate where this is unacceptable in the same way that drunk driving is, where people feel pressure from their peers, can help change this. However, structural changes are needed as well. For example, according to the IIHS survey, workplace policies that do not require or that discourage the use of phones while driving would help.

Tech solutions

There are potential technological solutions as well, such as more voice activation although even voice-only interactions can be distracting. Helping users better understand that they can turn off some notifications and keep urgent ones may also cut back on distraction.

Ultimately, social, structural and technological solutions need to work together in order to prevent distracted driving based on phone usage. Social pressure can also help reduce incidences of distracted driving caused by other actions as well. As people better understand the consequences of their actions and face disapproval from friends and family, they may drive more safely.

A Massachusetts police officer may take you into custody for drunk or impaired driving based on the results of field sobriety tests. However, you may be able to challenge the results of those tests as part of your criminal defense strategy. If your efforts are successful, it may weaken the case against you enough to have the charge dropped or reduced as part of a plea deal. On the other hand, it may also be enough to obtain an acquittal in your case.

Health issues may skew test results

The officer who conducts a field sobriety test is required to take any mental or physical health issues into account when judging your performance. For instance, if you have a broken leg, it may not be possible to keep it in the air for any time. It may also make walking or turning extremely difficult. If you have a mental issue, understanding what the officer is asking you to do may make it difficult or impossible. If it can be shown that these types of problems were ignored, a judge or prosecutor might agree to drop the charge or take other action.

Tests aren't always administered properly

A test that is not administered correctly may produce results that aren't meaningful when determining your level of impairment. Furthermore, not all tests you are asked to perform can accurately measure your impairment level. For instance, counting down from a specific number or reciting a portion of the alphabet backward may not prove anything other than your ability to count or memorize the order of the letters. Other tests, such as the one-leg stand that are commonly used, may not be reliable enough to stand up to scrutiny in court, which means challenging them may be an ideal criminal defense tactic.

If convicted of DUI, you may spend time in jail, lose your ability to drive, or face other consequences. However, casting doubt on evidence used to justify charging you with this crime may help you avoid some or all of these penalties.

Back injuries are a common problem for many Massachusetts workers, especially those who perform manual labor tasks. These injuries can result in chronic pain, loss of mobility and lost wages.

Causes of back injuries

Several factors can contribute to back injuries in the workplace, including:

Poor posture: Employees who spend long hours sitting at a desk, typing or working on a computer are at risk of developing poor posture which can lead to back pain.

Repetitive motions: Workers who perform repetitive tasks, such as lifting, twisting, or reaching, can develop repetitive strain injuries (RSIs) in the back.

Overuse: Employees who perform physical labor, such as construction workers or warehouse employees, risk developing back pain from overuse.

Lifting heavy objects: Employees required to lift heavy objects are at risk of developing back pain or even herniated discs.

Preventing back injuries

Employers and employees can take several steps to prevent workplace back injuries. Simple solutions can save employees from pain and expensive medical bills. In the case of a back injury, workers' compensation may help with the financial burden of damage to your back.

Maintaining good posture

Encouraging employees to sit up straight, keep their shoulders relaxed and take frequent breaks can help prevent back pain. While this may be difficult in some areas of employment, ergonomic solutions can help improve posture on the job. Providing ergonomic equipment, such as adjustable chairs and desks, can help prevent back pain from poor posture.

Implementing proper lifting techniques

Employees should be trained on the proper techniques for lifting heavy objects to reduce the risk of back pain. Squatting down instead of bending at the waist is essential for avoiding stress on the back.

Encouraging physical activity

Regular physical activity, such as stretching or exercise, can help prevent back pain by strengthening the muscles that support the spine. Incorporating such activity as a part of employment is something that mindful employers can do to care for the well-being of their workers.

Treating Back Injuries

Treatment for workplace back injuries varies depending on the cause and severity of the injury. In many cases, rest, ice and pain medication is enough to relieve the symptoms of back pain. Physical therapy or chiropractic care may also be recommended to help improve mobility and relieve pain. In severe cases, surgery may be necessary to correct a herniated disc or other spinal condition.

Keeping your back healthy

Back injuries can be a major problem for employees in various industries whether from use or accidents. By understanding the causes and taking steps to prevent back pain, employers and employees can work together to reduce the risk of such potentially life-changing back injuries. If you are experiencing back pain, it is essential to seek medical attention to determine the cause and receive appropriate care.

Although most drivers traveling on Massachusetts roads are responsible and safe, some behave recklessly. When that happens, people can get into a car accident and sustain injuries. If this has happened to you, these are the steps you can take.

What to do after a reckless driving accident

Contact the police. By law, the police must be called to the scene of any motor vehicle accident resulting in an injury or property damage over a specified amount. An officer will make an accident report; you can ask where to obtain a copy for your records. Get the name and badge number of the responding officer.

Exchange information with the reckless driver, but don’t make conversation. Although Massachusetts is a no-fault state and you have to go through your own insurance company to cover the costs of your damages, you may still need to sue them directly. Take photos of the accident scene, the road, traffic conditions and the weather. Anything pertinent could strengthen your claim.

Not all injuries are immediately apparent. Your body naturally pumps adrenaline after an accident, so you might not feel the effects of your injury until hours or days later. Even if you feel fine, it’s best to err on the side of caution and seek medical attention. Medical records can also back up your accident claim when you need to recover your out-of-pocket expenses.

Examples of reckless driving

Reckless driving is any type of aggressive or illegal practice behind the wheel that puts everyone else at risk. One of the most common examples is speeding or drag racing. Weaving in and out of lanes, not using signals to warn other drivers and ignoring traffic signs and road rules are also considered reckless driving.

Tailgating and road rage as a whole are other examples of reckless driving. These practices show disregard for other drivers, their passengers and pedestrians and can easily lead to car accidents.

For many people, this means bundling up and heading out into the cold for a winter drive. But before you hit the road, it's important to be aware of the hazards that come with driving in winter weather.

Ice and snow

Ice can quickly become slick and slippery, making it difficult to maintain control of your car. This is especially true when driving on bridges or overpasses where ice tends to form more easily. Snow can also obscure road markings, creating a dangerous situation for drivers who don't take extra precautions. On top of that, snow can accumulate quickly, making roads more difficult to navigate.

Storms

Winter storms can bring heavy snow and high winds, making visibility poor and increasing the chances of motor vehicle accidents. Sometimes, these storms can be so severe that they force roads to close, leaving drivers stranded.

Animals

Wild animals, such as deer or moose, can appear suddenly in the road, leading to the possibility of an accident and injuries. For instance, if a driver swerves to avoid an animal, they may end up losing control of the car or hitting another object.

Poor visibility

When the sun sets early in the winter months, drivers can find themselves driving in low light or complete darkness. This can make it difficult to navigate roads and spot potential hazards, such as ice patches or animals on the road.

The most important thing is to prepare. Make sure your car is in good condition and that you have the right tires for cold and snowy weather. It's also a good idea to allow extra time for any winter drives so that you can drive at a safe speed and have more time to react if something unexpected happens. Finally, be prepared for any emergency situation that might arise. Make sure you have a first aid kit and extra blankets in your car. By following these tips, you can ensure that winter driving is safe and enjoyable for everyone on the road.

Truck accidents are a leading cause of motor vehicle accidents in the United States. While it's possible to blame several common factors for these accidents, such as weather, road conditions or mechanical problems, fatigue is one of the most common and preventable causes.

How does fatigue lead to truck accidents?

Firstly, fatigue can cause truck drivers to lose focus and make mistakes. This can result in poor decision-making, such as driving too fast for conditions or not leaving enough space between the truck and other vehicles. Secondly, fatigue can cause drivers to fall asleep at the wheel and when this happens, the truck can veer off the road or into oncoming traffic, often with devastating results.

Thirdly, fatigue can cause drivers to have slower reaction times. This means that if another vehicle cuts in front of the truck, or if an obstacle appears in the road, the driver may not have enough time to react and avoid a collision.

What types of accidents are most likely to be caused by fatigue?

One of the most common types of accidents caused by fatigue is a rear-end collision. This is because when drivers are tired, they may not be able to brake in time to avoid hitting the car in front of them. Another common type of accident is a sideswipe, where the truck drifts into another lane and collides with a car or other object. Other motor vehicle accidents that can be caused by fatigue include rollovers, jackknives and head-on collisions.

What causes truck driver fatigue in the first place?

There are many factors that can contribute to truck driver fatigue. For example, drivers who work long hours or overnight shifts are more likely to feel tired. Drivers who don't get enough sleep are also at risk, as are those who have undiagnosed sleep disorders, such as sleep apnea. In addition, certain medications can cause drowsiness, and drivers who are ill or have a chronic medical condition may also be more prone to fatigue.

To avoid fatigue-related accidents, it's important for truck drivers to get enough sleep. Drivers should also take breaks every few hours to rest and should avoid driving if they're feeling tired. If possible, drivers should travel during the daytime, when they're more likely to be alert. In addition, companies that employ truck drivers should make sure that their employees are well-rested and not working excessive hours.

Being charged with a DUI in Massachusetts can disrupt your entire life. However, there are ways you can challenge the results of a breath test.

How breath tests work

While these tests are often reliable, there are times when they might not give accurate results. For example, eating certain types of foods or having certain medical conditions such as GERD can present a false positive reading on a breath test. A person should not be convicted of drunk driving as a result.

Common ways to challenge a breath test

If a police officer pulls you over on suspicion of driving under the influence, you have a right to challenge the results. In addition to the two reasons mentioned above, it’s possible that the Breathalyzer was not properly calibrated. If this is the case, then the defense could argue that the blood alcohol concentration reading the test gave is inaccurate.

Another way to challenge the breath test is to state that it was unreliable. Blowing several times into the test should produce the same result. However, if you get different readings each time, it’s considered unreliable.

Multiple breath tests should be done to ensure that the test is working properly. If the police officer only checked your breath once, you can challenge the results and explain that the test was only used once.

Using some type of product that contains alcohol can give false results on a breath test. For example, if you used mouthwash or a breath freshener shortly before the officer administered the test, you can challenge the results based on that.

A common challenge to a breath test is to claim that the police officer lacked reasonable suspicion to stop you. Police cannot randomly stop just anyone and request that they take a breath test. There must be some other reason to pull you over. This challenge could easily get the results thrown out.

If you are involved in an accident with someone who violates this duty, it may be possible to take legal action against that individual. There are several different ways in which a person may engage in negligent or reckless behavior.

Driving while impaired is dangerous

Generally speaking, a reckless act is one in which a person shows a blatant disregard for the safety of others. Driving while under the influence of drugs or alcohol makes it difficult or impossible to operate a vehicle safely. Consuming drugs or alcohol may make it harder to process information, lower inhibitions and otherwise put yourself and others at risk of being hurt or killed.

Excessive speed is problematic

Driving at a high rate of speed may make it harder to stop or slow down in a timely manner. It may also increase the severity of an accident because the amount of energy created at the point of impact is based on how fast a car is traveling when a collision occurs.

What to do after a crash

The first thing that you should do is stop and check for obvious signs of injury. If there are passengers in your car, make sure that they are alright before calling for help. After calling authorities, gather any evidence that might be available at the scene. Witness statements, photos or videos of the crash may make it easier to prove that your motor vehicle accident was caused by someone else's reckless behavior. In some cases, more than one party will be liable for any damages that you incur.

Motor vehicle accident cases may be resolved through a negotiated settlement or through a formal trial. It's possible that a settlement will be reached in your case after a trial date has been set. You may be able to collect a financial award from the defendant's estate if this person is killed in an accident caused by his or her reckless actions.

Massachusetts employers generally have a responsibility to protect their employees from workplace injuries. However, despite a company's best efforts, an accident may occur that results in a scratched cornea, blurry vision or other eye problems. Fortunately, there are steps that you can take to minimize your risk of getting hurt while you're at work.

Handle materials with care

If you are handling a jar, dish or large container filled with chemicals or other potentially harmful liquids, make sure that it is properly sealed. This may prevent anything from splashing into your eyes or getting on other parts of your body. It may also be helpful to wear gloves and be sure you know the location of all eye-wash stations on the premises.

Prevent eye strain

Putting your phone, tablet or laptop away for 20 seconds every 20 minutes can significantly reduce your chances of eye discomfort. Doing so allows your eyes to rehydrate, which can reduce redness, burning or other issues that may result in temporary or permanent vision loss. Continuously starting at a screen can also cause cluster headaches, migraines and other types of debilitating headaches. If you develop any of these conditions, you may be entitled to receive workers' compensation benefits.

If you are injured at work, it's critical to tell your employer as quickly as possible, and it's a good idea to document everything. If you tell your employer about your injury in person, recapping the conversation by sending an email provides a record of the conversation and their response to your concerns. You may also need to provide medical records about any doctors that you saw and treatments that you received, including from before you were hurt, so be sure to keep all documents.

In Massachusetts, you could be charged with burglary if you enter any structure without authorization. If convicted of the charge, you may spend time in jail, pay a fine or face other consequences. However, it's important to understand that you aren't guilty of a crime just because the government claims that you did something wrong. What does a prosecutor need to prove?

There must be an unauthorized entry into a structure

It's critical to understand that burglary occurs whenever you enter a structure without an owner's consent even if it isn't a house or office building. This means that you could be charged with burglary for entering a car that doesn't belong to you or try to enter your friend's boathouse without permission.

You don't have to enter by force

A burglary can still occur even if you enter a property through an open door or an unlocked window. A burglary charge may also stick if you achieve a constructive entry, which occurs if you are allowed to occupy a structure using threats of violence or blackmail toward others. Of course, you may assert as part of your criminal defense strategy that a door or window was left open specifically to allow you to get into a home or car.

There needs to be intent

In addition to proving that an unauthorized entry took place, a prosecutor would need to show that you intended to violate the law in some way. For instance, if you were caught in possession of alcohol as a minor, that would be enough to satisfy this element. You could also be charged with burglary if you intended to take something from a home, office building or boathouse even if you didn't actually leave with anything.

After being charged with a crime, you will be given an opportunity to cast doubt about the accusations made against you. This may be done by having evidence suppressed or disputing witness testimony provided to a jury at trial.
